The Crime Victims Compensation Board makes payments directly to those who conduct sexual assault examinations. State law prohibits the billing of patients solely for this expense. The provider bills the program directly.
Victims are not responsible for filing a claim with the Sexual Assault Examination Program and should not receive medical statements from the facility that performed the sexual assault examination. However, the victim may be charged for expenses not relating to the examination process (e.g., ambulance expenses, follow-up care, hospitalizations, surgical procedures). If the victim receives billing statements for unrelated expenses, he may file a claim with the Crime Victims Compensation Board.
The Sexual Assault Examination Program operates under the authority of KRS 346.200, KRS 216B.400 and KAR 107 2:010. Contact legal counsel G. Mitchell Mattingly at mitch.mattingly@ky.gov with questions about the statutes and regulations.
